Definitely not. Both are extras by definition. Profit sharing, bonuses and salary might be combined when speaking of a compensation package, but that's different.

It's common in my experience for an employment contract to assume a certain number of hours per week. In some jurisdictions, too, that number of hours is defined by law. But, in my experience, it's 40, not 45 hours (obviously, the definition is widely ignored).

You might want to check if there is any legal definition in your area; your employer might be trying to delay when over-time kicks in.

(I've always been under the assumption that a salaried employee is paid to get a job done. If it takes 38 hours -- great. If it takes 48 -- great.)


Most of the places I've worked operate under this assumption, too. However, if there are legal definitions, or if you get more money for over time, then a set number of hours might come into play.

I am particularly in disagreement with the assumption that OT pay should be considered when negotiating my salary,



The word "over time" makes clear that it isn't standard.

It's easy to become suspicious when dealing with bosses. However, I can't help thinking that your boss is trying to include all these extras so that you will accept a lower salary than you might do otherwise.

I also wonder if your boss is trying to make 45 hours the standard; if the law says that 40 hours is standard, then the company has an extra five hours before it has to pay you over time.

Some people might say that your boss is simply a hard negotiator. Maybe. But I'd also wonder if he was bargaining in good faith.
