In this thread there seems to be a confusion between "liability" and
"responsibility."

Taking responsibility for your own actions does not mitigate the liability
of another party for any harm that may have resulted from those same
actions.

The car-slipping-out-of-gear case cited in another posting is an excellent
case in point. Sure, maybe it wasn't such a great idea to exit the car with
the engine running, even with the shift in Park and the parking brake on
(this is called "taking responsibility"); but the manufacturer should not
have produced and distributed a car that does not perform a basic function
correctly (this is called "liability").
