I understand trademark to provide protection against palming off. Rough
example: If I was to sell a product named "Palm Salad Dressing," Palm
computer would have no more right to object than Microsoft would if I was to
set up a building maintenance company with the slogan "We Do Windows." I
think that there is no product confusion in either example. When you come to
products in the same generic filed, the question is closer. Candidly I don't
see a close enough similarity in the two logos to imply a relationship or to
cause confusion.
Just my thought.
