Aren't business models that rely on consumer ignorance fundamentally unstable?
Operative term is 'rely'.
Heck, I'd hazard most businesses are based on one or both of two fundamental ideas: 1 - The customer wishes to avoid doing the work because it is too time consuming or unpleasant, 2 - The customer doesn't know how to do it.
Seems to me that's a different matter from retaining rights the customer -- if he bothers to think about it -- reasonably assumes that he holds himself. Or would typically hold if he'd used another provider.
Now, if there's a stated and agreed delegation of rights that, say, enhances the service, nobody'd have a problem.
It depends, I guess, on how you feel about shrink-wrap licenses and the like, whereunder the customer agrees to the terms by the very act of examining them, or, ideally, doesn't examine them at all. Some folks reckon that's a deception, others feel that disclosure, however inaccessible and stacked, sounds the all's fair.
There's no doubt that most businesses are built around Person 'B' being willing to do (for a price) what Person 'A' is not. Yet who's to say how Person 'A' arrived at that preference, or if he will remain there for the same reasons as initially? To my taste, reaching into the relationship and *leveraging* customer ignorance for less than symbiotic purposes is dancing very close to the flame.
But this is far afield. I stand by the position that do-it-yourselfers should verify that they hold *all* controlling rights to the domain names they register, and if they contract for ancillary services, never to allow those rights to be attached. Can't think of any way they might be, except through what I regard as trickery.
Identity and privacy are on the line. The sinking realization that you don't control your online identity is bad enough. The next thing you'll discover is that domain-name disputes are murder to adjudicate.
