The problem is that for tech writer A working at company B, the ONLY legal opinion that counts is that of company B's counsel. If that attorney tells tech writer A that the company's policy is to put a TM symbol after each and every use of the trademark and further restricts the ways trademarks may and must be used in text, then, barring tech writer A's persuading the attorney to quit making an ass of himself, tech writer A has to follow that policy, whether you and I think there's a legal reason for it or not.
