Not necessarily. First, if you have formally registered the
copyright, you're entitled to statutory damages (which are high)
without having to prove any economic losses or other damage. (I have
a friend who used this successfully to claim several thousand dollars
from a client who refused to pay him for his work but used the work
anyway.) Second, the threat of legal action is usually enough to make
someone back down when they're in the wrong. If you haven't formally
registered copyright, you can force someone to comply with the law
and depublish your property, but you have to prove damages if you
want to claim any money.
