"Distribution" is a normal part of their duties (they're drivers). "Packing for distribution" is not (they don't "pack").
If the serial comma had been included, then "distribution" would have been set off as its own task, and they would therefore be exempt from overtime.
Without the comma, it becomes "packing for shipment or distribution" which is the equivalent of "(packing for shipment) or (packing for distribution)." Because in this case "distribution" is not listed as an exemption, they would be eligible for overtime.
If the comma had been there they would have lost, and would likely not have brought the case.
