I heard - and have been unable to find any verification of it - that the
new tax bill that was enacted this summer contained some wording that
changed the old "20 questions" rule, an actually made it easier to be a
contractor, in terms of dealing with the IRS. In Silicon Valley, the
contracting agencies don't seem to be motivated to go look up the
language because it's easier for them to be hard-nosed about "everyone
has to be W-2" than deal with the vagaries of each work situation.
As an agency, can you find that wording and let the rest of us know? It
was supposed to make it easier to stay 1099. Of course, it will make
things harder for the lazy agencies around here who want to hide behind
the old rules, but at least the rest of us will know what the new law
*really* is.
