Unfortunately, tracy's right. it's a work-at-will kinda' world. If you
don't agree to their set work practices, you have the right and the ability
to go elsewhere. You may balk at the idea of a drug test, dress code, but
so long as they're not forcing you to wear a dress and pearl earrings (with
my beard/mustache they wouldn't go any way), and you happen to be male, it's
really not of any use to claim that it's against the law for an employer to
ask for a drug test, writing test, NDA, etc.

Unless the employer IS testing for something OTHER than those substances
that they claim they are testing for then I don't see where your rights are
being violated. Your prospective employer is stating quite clearly that
they want you to abide by their requirements for employment, none of them
seem biased or unnecessary, by agreeing to the requirements for employment
you're being asked to take a drug screening test, writing test, what have
you, so what rights are they violating if you're agreeing to take these
tests?

IMHO, an employer who asks you to submit to a drug test as a condition of
employment is not violating your rights, since you clearly have the option
to refuse. Yes, you'd probably lose the job, but it's not that different
from other conditions of employment, such as a dress code or mandatory
overtime or even, God forbid, a writing test, that could also result in the
loss of your job if you decline. I agree that it's distasteful, but I don't
think it's a violation of your civil rights. Unless they test for something
other than the particular substances they inform you they're testing for, of
course.
