The 216-color paletter refers to the HTML hex codes for RGB values and applies to backgrounds, fonts, borders (I think that's all, actually). It never had anything to do with the contents of a jpeg.

I still try to stick with the 216-color cube, but I'll admit I haven't witnessed any disasters caused by the occasional violation, at least not since about AOL version 3. I guess it depends who is going to visit your site. If it is only going to be seen by people sitting in modern offices with up-to-date computers and software, you don't have much to worry about. If it is going to be surfed by people all over the world using elderly computers, then you might do well to adhere to it.
