Given the points you've made, I think there's a decent case for legal
issues if an appendix is used, not to mention your valid argument about
what the customer should expect. Add to that the considerations Hannah
brought up.
Can't believe he's so over-worked that additional ECOs are that much of a
problem, though that's just my take.
Rick, the pricing for such a system surely should include whatever docs are required. That your company failed to factor replacement docs into the price should not be any of your concern. The cost of re-engineering a bad design to meet possible legal issues is part of the overhead that must be included in the original contract. A badly designed bracket? Or incorrect documentation? Or a set of tires insufficient to hold the actual load? All should be replaced under terms and pricing anticipated in the original contract.
If anyone's unsure, he should ask the company's legal department. They'll set him straight.
