I don't think this is actually true (in the US). People seem to think that
there is a long list of laws against discrimination, but there is a
difference between discrimination when hiring and discrimination when
firing.
When hiring (or firing), you can't discriminate on race, color, religion,
sex and national origin, or age or physical disability (when age/disability
doesn't affect the person's ability to do the job being interviewed for).
These are the only bases on which there are actual US laws.
You can certainly discriminate on sexual orientation (that's what all these
"special class" fights are over in practically every state). You can
discriminate on size, looks, personality, brains, personal habits. You may
be taken to civil court, where a whole set of personal opinions then apply,
but no definitive laws (and there won't be until the US Supreme Court rules
on an issue, and even then there is room for interpretation). This is where
the hiring/firing difference seems to come in--it's harder to justify firing
for "frivolous" reasons than to justify not hiring.
