Yes, as I recall Sun's response to the suit was that they required her 
to work the extra hours as part of a "performance improvement plan."  
However, that argument was BS, because they were doing it to enough 
writers for make up a class action suit AND were requiring a specific 
number of hours instead of setting actual performance improvement goals.

When I was a manager, my idea of "performance improvement" would have 
been coaching writers who were working 60 hours a week until they could 
get the same work done in 40. Making a writer whose 40-hour week 
produces unacceptable results put in 60 hours just gets you 50% more 
unacceptable results.
