Trademark. So if you have a product like Microsoft is a trademark. It should, if used properly, show up as Microsoft in order for MS to properly be using their own Trademark or they could potentially lose the rights to it. They used their company name and they went through the steps to trademark it but then didnât use it. I came along and ran a search to see if it was used anywhere in the US, found their company, saw they didnât do what I did, plus they had no trademarks anywhere on their site and proceeded to use it for about 6 years before they contacted me. Interestingly, another company down the street from me had the same company name but followed it by Window Coverings and they didnât get sued.

It's tedious but I used to work on checking all that stuff with legal before publishing and I still occasionally have to do that. Trademarks have to be used appropriately too.

I'd checked before picking that name and the company had not used their trademark at all on their web site or other materials. Plus their business wasn't similar. I did have to change my company name, but they had to pay me for my expenses to do it because they didn't use their mark correctly and they almost lost their rights to their name, plus they pulled their web site down for 6 mos to rewrite it so that it appeared on every page.
